社群主义权利观主张共同善优先于个人权利,是对自由主义权利观批判的产物,有其特殊的历史与现实背景,本身没有普遍的意义,但其理论观点却对当下中国法治建设的有关权利立法、法治形成等方面具有重要的启示意义.
