我国流浪儿童的受义务教育权问题,无论是法律规定,还是社会实践都存在缺位.保障流浪儿童的受义务教育权是解决流浪儿童这一社会问题的关键.国家是保障流浪儿童受义务教育权的最终责任者.履行这一国家义务的最主要的形式就是立法、监督和资助.
