Abstract：
设立国内仲裁裁决司法审查制度有其理论依据和现实意义.国内仲裁裁决司法审查的范围应包括程序问题和实体问题,以是否违背公平、公正和当事人意思自治为标准;国内仲裁裁决的司法审查应参照适用特别程序,仲裁庭应为＂法定证人＂,应允许当事人对司法审查所作出的裁定上诉.
