Abstract：
我国现行有关生产者延伸责任的规定大多属于政策性、鼓励性的规范,选择权掌握在生产者手中。不仅无法对违反法律法规或规章的生产者起到足够的约束或制裁作用,而且还会打击那些正在承担延伸责任之生产者的积极性,从而使得此制度的实施受到极大的挑战。可以说,生产者延伸责任目前还只是一种＂纸面上的责任＂。
