必须先研究环境行政行为效力生成的动态过程,才能准确把握环境行政违法行为的效力是处于怎样的状态。效力生成过程包括成立、生效和有效三个阶段,在三种情况下环境行政行为有效,即确定有效、法定有效和意定有效。
