以房抵债协议自发产生于民间借贷需求高,金融与信贷体系不完善,传统的典型担保方式手续复杂、成本高的背景之下,虽然是当事人出于意思自治签订的协议,但是却往往因为无法律对此有明确的规定而被判定为无效.学界和实务界对以房抵债的性质观点不一、争论不休.本文将以房抵债定性为代物清偿预约.
