The　title　complex　was　prepared　and　its　crystal　structure　was　determined,　The　crystal　is　space　group　　with　parameters,　a　=　1,191　1(2)　nm,　b　=　1.532　2(2)　nm,　c　=　1.049　2(2)　nm,　a　=　108.98(1)degrees,　beta　=　107.04(1)degrees　gamma　=　70.25(1)degrees,　Z　=　2,　T　=　296　K　and　the　final　R　=　0.054　1　for　3　998　observed　reflections,　The　Cu　atom　is　five-coordinated　with　a　distorted　trigonal　bipyramid.　Four　nitrogen　atoms　from　two　2,2＇-dipyridyl　ligands　and　one　carboxyl　oxygen　atom　from　benzilate　form　a　distorted　trigonal　plane,　while　the　other　two　nitrogen　atoms　from　the　two　2,2＇-dipyridyl　ligands　occupy　the　two　axial　positions.　The　assignment　in　IR　spectrum　is　discussed.
